The Federal Employers' Association of Personnel Service Providers e. V. ( BAP ) is a German employers 'association in the temporary employment sector , which emerged in April 2011 from the merger of the two employers' association of medium- sized personnel service providers ( AMP) and the Federal Association of Temporary Employment Services (BZA).

Structure and tasks

The association represents the interests of the personnel service and temporary employment industry in Germany. It bundles the strengths of the personnel service providers and is committed to representing and promoting the interests of its members in relation to personnel services and issues of the labor market. Currently more than 2,000 members with over 4,800 personnel service companies in Germany are organized in the BAP. The association unites a good 50 percent of the industry - in terms of turnover or temporary workers - under one roof. In addition to the large, international companies in the industry, around 95 percent of the association's members are small and medium-sized companies.

The BAP actively organizes the exchange of information and ideas with the legislature, ministries, parties, associations, public institutions and the media in Germany. In addition to political work and public relations work, the BAP is primarily available as a legal advisor for its members. By promoting the exchange of education and science in the field of personnel services, the association assumes social responsibility. The association is active in the fields of politics, law, digitization, integration, education, international affairs, press / public relations and personnel placement.

In addition, as part of the collective bargaining partnership with the trade unions of the German Federation of Trade Unions, the association regularly negotiates the collective bargaining conditions for employment in temporary work. The BAP advocates fair working conditions in the industry with a code of conduct, which an arbitration tribunal ensures compliance with.

The BAP is a registered association with the purpose of promoting working and economic conditions in the field of personal services. In addition, it safeguards the common interests of the members vis-à-vis politics, social partners, science and the public.

The most important organs of the BAP are the general assembly, the board of directors, the presidium, the office, the committees, working groups and groups as well as the collective bargaining policy with the collective bargaining commission. The general meeting takes place annually and elects the president, the presidium and the board for a term of three years each. The general meeting is also responsible for the budget and the fee schedule. The next general meeting is planned for May 23, 2019.

The president of the BAP is the entrepreneur Sebastian Lazay. In addition to Lazay, eight vice-presidents are represented in the executive committee of the BAP. The board of the association consists of the nine members of the presidium and nine other people.

The main management is appointed by the board on the proposal of the president. Florian Swyter has been General Manager of the BAP since April 1, 2020 .

The BAP is active in nine regions across Germany. The regional spokespersons and their deputies are the contact persons for the member companies on site. They organize the meetings and the exchange of information within the BAP regions.

In Germany, the BAP is also organized in the Federal Association of German Employers' Associations (BDA) , in the Federal Association of Wholesale, Foreign Trade and Services (BGA) and in the Federal Association of the Service Industry (BDWi). At the international level, the BAP is the only industry association in Germany to represent the interests of personnel service companies in the World Employment Confederation (WEC) and at European level in the World Employment Confederation - Europe (WEC-Europe).

Collective agreements and collective bargaining coverage

The BAP is the legal successor to the AMP and BZA associations, from whose merger it was created. The collective agreements concluded with the DGB trade unions before the merger were not affected by this.

The predecessor association of the BAP, together with the collective agreement for temporary work of the DGB, concluded a nationwide collective agreement for the temporary work sector. The collective bargaining system comprises the general collective bargaining agreement (MTV-BAP), general collective bargaining agreement (ERTV-BAP), collective bargaining agreement (ETV-BAP) and currently eleven industry-specific collective bargaining agreements (TV-BZ). The minimum conditions for temporary workers in Germany are regulated in the collective bargaining agreements, who usually receive an open-ended employment contract with pension, health, unemployment, long-term care and accident insurance, etc.
