The federal advocacy group for old people and people affected by care (BIVA) e. V. (formerly: Federal interest group for users of housing and care offers in old age and with disabilities ) is an independent self-help association that has been committed to strengthening the rights of residents of all types of homes and housing since 1974. To this day, it is the only nationwide representation of interests for residents of residential homes for the elderly , disabled people , care facilities and users of outpatient care offers as well as for their relatives. It is politically and religiously independent and is financed through membership fees, donations and public funding projects.

BIVA is one of the 78 selected associations in Germany that are allowed to carry out a model declaratory action .

history

On October 2, 1974 in Bad Soden am Taunus, eleven residents of various homes founded the “Interest group for the loan residents of old people's homes, old people's homes and similar institutions e. V. “(IG) based in Bonn-Bad Godesberg . It was entered in the Bonn Register of Associations (VR 3939) on May 8, 1975 . The reason for the establishment was the inadequate legal security, especially for the loan-giving home residents, who at the time ran the risk of losing their savings if the home owner was insolvent .

In the following years, the association expanded its activities to represent all residents of homes for the elderly and the disabled and to the users of outpatient care services.

tasks and goals

The main goal of BIVA is to ensure the quality of life in all types of homes and living arrangements. This includes privacy, respect for the dignity of the elderly, self-determination and self-realization, preservation of physical integrity , freedom to choose the range of services and legal security. As a consumer protection organization, BIVA is entered in the list of associations registered with the Bundestag. Since December 2016, it has been a qualified institution in accordance with Section 4 of the Injunction Act (UKlaG)

The BIVA operates neutral consumer advice and information on housing and care offers in old age. She provides legal advice that encompasses both the social law as well as the regulatory and civil law areas of home law ( Landesheimgesetz , Book 11 of the Social Code and Book 12 of the Social Code , Housing and Care Contract Act (WBVG)).

training

In addition, BIVA advocates the involvement of residents and users of care facilities and dormitories in the decisions of the home providers. With the aim to strengthen the cooperation in nursing homes, schools lawyers on behalf of BIVA after the respective country Homes Act provided Home Councils to their duties, rights and obligations.

Education and information

BIVA provides information on all aspects of housing and care in old age. On the website biva.de there is an extensive free online archive of brochures, leaflets, judgments, relevant laws and articles on these topics.

Political lobbying

BIVA has been involved in many laws, advised politicians and represented the position of those affected. The reason for the establishment in 1974 was the lack of legal protection at the time, especially for the loan-giving home residents, who ran the risk of losing their last savings if the home owner were unable to pay. In the statutory ordinances on the first home law, the then BIVA already represented the concerns of its members and is still involved in most amendments to the home legislation of the federal and state governments.

Projects

An important individual project in 2009 was the online portal “Home Directory”. Since its foundation, BIVA has carried out numerous public funding projects at state and federal level. In cooperation with the Institute for Social Infrastructure (ISIS) and supported by the Federal Ministry of Food, Agriculture and Consumer Protection , the BIVA established a directory of all nursing homes in Germany with information on services and quality of life. The criteria for recording quality of life and the indicators to be assigned to them were compiled on the basis of standards of the WHO and the “Charter of the Rights of People in Need of Care” as well as taking into account further research and are divided into the areas of participation, autonomy and human dignity. The “Green Hook ©” seal was awarded by BIVA until 2012, as long as the project was financially supported by the Federal Ministry of Food, Agriculture and Consumer Protection. Since May 2012 the home directory has been legally and economically on its own two feet as a non-profit company. BIVA is a partner in Heimverzeichnis gGmbH, but no longer has any influence on the quality of the data and the certification with the "green hook".

The Internet portal Pflegeegüte.de, which is supported by the Stark im Alter foundation, takes a different approach. Behind this is the effort to make the care sector more transparent. For this purpose, large amounts of data relating to the economic sector of geriatric care and care quality are collected and clearly presented, from the test results of the Medical Service of Health Insurance (MDK) to press articles on individual inpatient facilities or care services.
