Diligentia quam in suis

Diligentia quam in suis , completely actually diligentia quam in suis rebus adhibere solet ( Latin for "the care that is applied in one's own affairs") is a certain standard of fault , legally defined in § 277 of the Civil Code (BGB) . The standard thus serves to fill in the element of “customary care”, as contained in paragraphs §§ 690 , 708 , 1359 , 1664 .

According to legal historians , the standard of liability in Roman private law first gained importance in epi- classical law, there in particular in the case of societas under company law . Despite the relativization of the due diligence requirements, the conviction on the basis of an actio pro socio (about the social conflict ) had an infamous effect .
