Point of single contact

The point of single contact (EA, EAP) according to of the EU Services Directive is a business service that is available to service providers as a procedural mediator and for information requests. The point of single contact simplifies and accelerates administrative procedures for service providers considerably by replacing all official agency procedures relevant to the service guidelines. The point of single contact has been available since December 28, 2009, the end of the implementation period for the Services Directive.

Service providers can handle all the procedures and formalities required to start and perform their service activities through the point of single contact. The point of single contact serves as a procedural guide and mediator. The Services Directive expressly states that the establishment of points of single contact does not affect the distribution of responsibilities between authorities in national systems. The point of single contact therefore acts as a front office or one-stop shop , accepts applications from service providers and forwards them to the responsible authorities . Service providers therefore do not have to communicate with the responsible authorities, but only with a body. In addition, the guideline provides that applications can be processed electronically via the point of single contact. Service providers no longer have to go to the office, but can - saving time and money - deal with all procedures and formalities with the PC.

Design in Germany

According to the federal distribution of responsibilities, the establishment of the point of single contact is the responsibility of the federal states that have chosen different location models. Although the point of single contact is only for cross-border issues, i. H. must be available for EU foreigners, there was early agreement in Germany to enable the use of the point of single contact also for German service providers.

The number of points of single contact may vary depending on regional and local responsibilities (see recital 48 of the Services Directive). The 16 federal states have also chosen structures that take regional conditions into account. Nevertheless, a subjectively uniform contact person will be available for every service provider, whom he can turn to for handling all service-relevant procedures and formalities. In contrast to other EC member states, there was an early belief in Germany that service providers should also be able to visit the point of single contact personally.

Implementation in Brandenburg

In the state of Brandenburg, the point of single contact for the state of Brandenburg (EAPBbg) is centrally located in the Ministry of Economics and European Affairs of the state of Brandenburg.

Provision of information

Service providers and service recipients have access to extensive information on all aspects of taking up and performing service activities via the EAPBbg Internet portal. Potential or already existing service providers can have a personal checklist for their specific project automatically created here. The responsible authorities in the state of Brandenburg can be found, including electronic, telephone and local contact information, using a responsibility finder. Furthermore, information on service-relevant approval processes (procedure descriptions) and information on consumer protection is available on the e-government portal. Citizens can also submit information requests to the EAPBbg by post, telephone or in person.

Electronic processing of proceedings

The administrative procedures required for setting up a company for various service activities can then be processed electronically via the EAPBbg Internet portal. Applications and advertisements are filled out online with the help of a question assistant. The documents generated as well as other evidence to be provided can be electronically signed within the portal and transmitted to the EAPBbg. After processing by the EAPBbg and the relevant competent authorities, applicants receive the initial documents of the administrative procedure (e.g. confirmation of the business registration ) also electronically via the EAPBbg's internet portal.

Implementation in Hessen

The Point of Single Contact Hesse (EAH) was set up at the regional councils in Hesse (regional councils Kassel, Gießen and Darmstadt). The regional councils are intermediate authorities between the state government and the local government.

Legal basis

The Act on the Single Contact Person Hesse (EAH Act - EAHG) is decisive for the activities of the Single Contact Person Hessen. The law came into force on December 28, 2009 and is valid until December 31, 2014. It was published in GVBl I 2009, page 716.

There is also an "Ordinance on the technical requirements for the process of data transfers between the Point of Single Contact in Hessen and the responsible authorities (EAH Data Transfer Ordinance - EAHDatenÜVO)". This came into force on December 31, 2009 and is valid until December 31, 2014.

In accordance with Section 4 EAHG in conjunction with the administrative cost regulations for the business area of ​​the Ministry of Economics, Transport and Regional Development (VwKostO-MWVL), no fee is generally charged for using the single point of contact in Hessen. In exceptional cases, in the case of very extensive procedures with great administrative effort, the fee is based on the time required by the EAH. This is the case if, for example, multiple queries had to be made, but in each case no more than half of the fee provided for the decision on the matter will be charged. No fee is charged for information requests.

Technical implementation of the requirements from the EG DLR

When implementing the Services Directive, the single point of contact in Hessen focused on the electronic processing of the procedures. The service platform and the online application were developed for this purpose. These can be used to electronically process all administrative procedures related to the start, change or abandonment of a trade. The online application is available in German and English.

Information task

In addition to the technical implementation, the Point of Single Contact in Hessen is also available for information requests. The Point of Single Contact Hessen fulfills part of its informational task through the Hessen Finder. This provides information on official services and responsibilities. There is also the EAH portal on which a lot of information on setting up a business and related administrative procedures is available. However, it is also possible to visit the point of single contact personally.

Implementation in Hamburg

The tasks of the point of single contact in Hamburg are, in accordance with § 2 of the Hamburg law on the implementation of the tasks of the point of single contact (HmbEAG), carried out by a Hamburg community of six economic and professional chambers. Operational branches are maintained by the Hamburg Chamber of Commerce and the Hamburg Chamber of Crafts .

The core tasks of the single point of contact in Hamburg are the provision of information and the handling of procedures in accordance with the requirements of the EC Services Directive .

Provision of information

The Point of Single Contact Hamburg advises companies and founders from Germany, Europe and around the world, in particular on the following topics:

  • Commercial licensing requirements and procedural issues,
  • Access to public registers,
  • Responsibilities in the Hamburg administration,
  • Further advice offers.

Handling of proceedings

As a one-stop shop in connection with the establishment and management of the company, the point of single contact takes on the following tasks:

  • Receipt and completeness check of commercial law applications, notifications, declarations of intent and documents,
  • Determination of the competent authorities and forwarding of documents to them,
  • Mediation between companies and authorities in the event of queries,
  • Observation of the course of the procedure, information on the status of the procedure,
  • Advice on offers of help in the event of difficulties in the course of the procedure.

Implementation in Berlin

Implementation in North Rhine-Westphalia

The Point of Single Contact North Rhine-Westphalia (EA NRW) has been located in the Detmold district government since January 2016.

Implementation in Saxony-Anhalt

The single point of contact for the state of Saxony-Anhalt is the state administration office according to § 2 of the law on the single point of contact (EAG LSA) of December 16, 2009.

The point of single contact offers companies and company founders from Germany and all EU / EEA countries who want to settle in Saxony-Anhalt a comprehensive and free range of services consisting of information, advice and support in handling official approval procedures for numerous service activities.

Information and advice

The EA provides information on project-specific requirements, procedures and formalities, contact details for the competent authorities and the expected duration of the procedure. Service- related information can be obtained and procedures processed on the website of Point of Single Contact . The forms provided there can be filled out online, electronically signed and handed over to the EA. The current status of the proceedings can be followed online by the service provider.

Administrative procedural significance

The point of single contact has made a supplement to the Administrative Procedure Act necessary. The Fourth Act to Change Administrative Procedure Regulations (4th VwVfÄndG), which came into force on December 18, 2008, laid the foundation for the work of the points of single contact with the newly introduced "Procedure via a single body" (Sections 71a to 71e VwVfG). The federal states have adapted their administrative procedure laws accordingly.

Electronic processing of proceedings

The Services Directive provides that service providers can easily handle all the procedures and formalities required to start and perform their service activities remotely and electronically. This makes it necessary that both points of single contact and the responsible authorities provide an IT infrastructure. The technical implementation of the guideline varies between the federal states.
