Energy and Water Utilities Regulatory Authority

The Energy and Water Utilities Regulatory Authority (EWURA), roughly German: “Energy and Water Supply Regulatory Authority ”, is a state authority in Tanzania .

EWURA was created and operates on the basis of the Energy and Water Utilities Regulatory Authority Act, 2001 (legally revised version of July 31, 2006), which is regulated in section 4 ( Establishment of the Authority ) of this law. The chairmanship ( chairman ) has been exercised since August 24, 2015 by Jamidu Katima, a professor of chemical engineering at the University of Dar es Salaam . Felix Ngamlagosi has been the director general of the regulatory authority since February 2014 .

Authority management

EWURA by a Board of Directors (German as: "Board") passed ( section 8 (1) ), which consists of a chairman ( Chairman (), five Directors and a Director-General Director-General ) is.

The Chairman of the Board of EWURA is appointed by the Tanzanian President . The five board members are appointed by the minister responsible for the authority after consultation with other ministries involved in the matter.

The Director General leads the authority for a term of four years (can be reappointed) and is appointed by the responsible minister on the proposal of a nomination committee ( section 14 ). The requirements for this office holder include a degree from a recognized university as well as proven experience in one or more fields of activity in the areas of corporate management, law, economics, finance or engineering. He has to prove that he does not have any personal conflict of interest when performing the duties as head of the authority. The section 14 (4) determines that he as its CEO functions and to no other activity may exert a parallel compensation. According to section 15 , further department directors can be employed.

Authority structure

The following departments exist below the management level:

  • Electrical energy,
  • Oil,
  • Natural gas,
  • Water and sanitation,
  • Legal issues,
  • economic regulatory issues and
  • Corporate affairs.

The seat of the authority is in Dar es Salaam .

EWURA is represented regionally by offices at two other locations.

  • EWURA Northern Zone Office in Arusha ,
  • EWURA Southern Highland Zone Office in Mbeya .

Responsibilities and working methods

Within the scope of its technical responsibility, EWURA deals with regulatory tasks in the areas of electrical energy, petroleum products as energy sources, water and wastewater, natural gas and the granting of licenses in this regard. Regulatory decisions can affect economic and technical issues.

According to the provisions of section 6 of the EWURA law, the regulatory authority fulfills tasks according to the following aspects:

  • promoting effective competition and economic efficiency;
  • the protection of consumer interests ;
  • protecting the financial sustainability of efficient providers;
  • promoting the availability of regulated services to all consumers, including low-income, rural, and disadvantaged consumers;
  • improving public awareness, knowledge and understanding of the regulated energy and water supply sector, taking into account the rights and obligations of all consumers; and
  • the consideration of the requirements for the protection and preservation of the environment.

The activity of the authority is expressly bound by legal requirements to the provisions of the Fair Competition Act (German for example: Law for fair competition) and the Tanzania Bureau of Standards Act (German for example: Law of the standards authority) ( section 20 (2a) ).

EWURA publishes its regulatory decisions in the Government Gazette of Tanzania, the country's official notification organ . The respective regulatory decisions include local taxes, tariffs and fees ( section 17 (3) ).

According to the EWURA law ( sections 30 and 31 ), the authority is advised by a seven-member consumer advisory council ( EWURA Consumer Consultative Council ), which is composed of people who use commercial energy or water and / or representatives of representative consumer associations. On the basis of its mediating task fulfillment, this advisory board serves to advise the authority on three major consumer groups:

  • a) people with low income, rural provenance and in disadvantaged situations,
  • b) industrial and other commercial consumers,
  • c) Representatives of the government and community- oriented speaker communities .

The establishment of regional and sectoral consumer advisory councils is possible.
