The German Driving License Ordinance (FeV) of August 18, 1998 is in the area of traffic law the successor regulation to Part A ( admission of persons to road traffic ) of the Road Traffic Licensing Regulations (StVZO, former §§ 1 to 15).

The new regulation had become necessary as part of the harmonization of traffic law in the European Community , in particular with the standardization of driving license law and the adoption of international driving license classes. The summary of all driving license regulations in a separate regulation underlines the importance of the regulations, increases the degree of binding force and simplifies the overview. In addition, new provisions on the central driver's license register , the medical-psychological examination and the driver's license test have been included .

The earlier regulation on international motor vehicle traffic has been incorporated into the driver's license regulation since July 30, 2008 ( Federal Law Gazette I p. 1338 ).

The FeV was first issued as a national ordinance to implement Directive 91/439 / EEC of July 29, 1991. The current version is the Directive 2006/126 / EC on driving licenses issued on December 20, 2006 .

The FeV is divided into the following sections:

  • General regulations on participation in road traffic: with the basic provisions on the admission of people to road traffic, the restriction and withdrawal of approval ( §§ 1 to 3 );
  • Driving motor vehicles: with the requirements for issuing a driving license , the procedural regulations for the allocation of a driving license, the division into driving license classes, the minimum age, the regulations for a driving license on probation, the point system and the measures to withdraw or restrict the driving license ( §§ 4 to 48b );
  • Register: regulates the procedure for storing driver's license data in the central driver's license register in Flensburg ( §§ 49 to 64 );
  • Recognition and assessment: describes who is allowed to carry out which medical and / or psychological examinations (e.g. MPU ) (see also: Assessment of fitness to drive ) ( Sections 65 to 72 ).
  • Implementation, fine and final regulations: contains the warnings for fines for violations of the FeV as well as other general regulations ( §§ 73 to 78 ).
