Film agreement

A film agreement is struck between two or more states agreement that a legal basis for interstate film productions represents.

Important points that a film agreement regulates are the relationship between the amount of financial participation and the resulting claims to artistic and technical participation in the film as well as to proceeds and film material . In addition to general provisions on labor and property law , such an agreement usually also provides for relief with travel regulations , labor law and the import and export of technical and other rotating material.

A mixed commission is usually set up to review the agreement, made up of government representatives and experts from the contracting countries. This commission meets regularly, approximately annually, unless an extraordinary meeting takes place.

A distinction is made between a minority producer and a majority producer according to the amount of financial participation in the production costs of a film. As a result, the majority producer has more rights in the selection of staff and actors, as well as higher shares in all proceeds. The country of the majority producer is usually also that which is mentioned as the main production country at film festivals or other events. Exceptions can, for example, also specify the country of the director as the country of origin of the film.

European conventions

In 1992 the member states of the Council of Europe concluded the European Agreement on the Co-production of Cinematographic Films ( Federal Law Gazette 1994 II pp. 3566, 3567 ) in order to promote the further development of European co-production of cinema films according to uniform provisions. However, many EU countries still have bilateral film agreements that go further than the European agreement.

The agreement that regulates co-productions between Austrian and German film production companies is the co-production agreement between Austria and Germany . This regulates the division of film cast and staff as well as the nationality of an Austrian-German film company with regard to participation in film festivals .
