The GSB Gesellschaft zuricherung von Bergmannswohnungen mbH was founded on December 16, 1981. prehistory

When Ruhrkohle AG was founded in 1969 as a rescue company for Ruhr mining, the company apartments remained with the old companies, in particular with Harpener Bergbau AG . The "bracket" of this housing stock formed the continuing occupancy rights of the mining industry and Ruhrkohle AG. This was initially secured by the "miners' housing contract" until December 31, 1988. However, the contract did not rule out that the parent companies could sell their apartments. The principles

The GSB propagates the model of " socially acceptable tenant privatization " of single and two-family houses and the purchase of multi-family houses by non-profit housing companies. In the so-called "10 commandments", the "principles of the GSB" are summarized in simplified language:

  2. Before the sale, the owners RAG / GSB agree on the principles of the purchase price.
  3. Fittings / improvements made by the tenant will not be taken into account in the assessment unless the owner has reimbursed the costs. Other improvements or reductions in value are taken into account through surcharges and discounts. The purchase prices determined in this way are communicated to GSB for comment.
  4. The main features and the chronological order of the privatization are to be agreed between the owner and GSB.
  5. RAG and GSB will support the privatization with advice and action.
  6. To avoid speculative resale of privatized apartments, a ten-year repurchase right is stipulated in the individual purchase agreements.
  7. Tenants who do not want to purchase property are granted permanent right of residence.
  8. If apartments become vacant, RAG buyers must be named who belong to the group or are entitled to live in accordance with the Miners' Housing Act.
  9. When selling two-family houses to one of the two tenants, the owner must conclude an agreement with the buyer that secures the right of residence of the remaining tenant.
  10. The sales are made using a model contract that is agreed between the owner and GSB.

Meaning today

The GSB was controversial among tenant representatives from the start because the focus is on the idea of ​​“employee-owned home ownership”, with the often associated changes in the appearance and in the established neighborhoods of the settlements. Efforts to find cooperative solutions or a settlement purchase by non-profit-oriented housing associations had little chance against the more lucrative individual privatization. After the abolition of non-profit housing in 1988 and the sale of large housing companies to private equity funds, another problem became apparent: many of the occupancy rights had expired due to the modalities of financial support or due to lack of demand from active miners. From the beginning of around 250,000 apartments, the number of occupancy-bound apartments fell to around 90,000 by 2005. For many miners' pensioners and their relatives, the permanent protection against dismissal for their home was called into question. In 2005, GSB succeeded in securing housing rights for miners' apartments even without an existing occupancy right through an additional agreement with its shareholder Viterra , one of Vonovia's predecessors. Today it can be assumed that all mining-related apartments belonging to the shareholders of GSB are subject to special tenant protection for mining members and that this must also be taken over by buyers in the event of settlement sales.
