The law on non-adjustment of official salary and living allowance of the members of the Federal Government and the Parliamentary Secretaries determined that unlike the in § 11 Federal Minister Act and § 5 Law on the Legal Status of Parliamentary Secretaries fixed emoluments the salaries are lower. As a lex specialis , it takes precedence over these two laws.

The official salaries and local bonuses are due to the permanent decoupling from the general salary increases by the law on the non-adjustment of official salaries and local bonuses of the members of the federal government ( Federal Chancellor and Federal Minister ) and the parliamentary state secretaries in the years 1992 to 1994 as well as the law on the exclusion of official , Official and pension payments from the income adjustments 2003/2004 , the law on the adjustment of service and pension payments in the federal government 2008/2009 and the law on the adjustment of service and pension payments in the federal government 2010/2011 significantly lower than provided for in the federal ministers' law.

According to the law, the members of the Federal Government and the Parliamentary State Secretaries of the Federation receive their statutory remuneration in the form of the official salary and the local allowance only in the amount as they are based on the status of the Federal Salary and Pension Adjustment Act 1991 and taking into account Article 2 of the Law of May 28, 1990 . In the Federal Salary and Pension Adjustment Act 1991 , the basic salary for salary group B 11 was DM 15,052.44.

Article 3 (amendment of the Federal Salary Act ) of the law on the reform of public service law of February 24, 1997 ( Federal Law Gazette I p. 322 ) does not apply to the official remuneration of the members of the Federal Government and the Federal Parliamentary State Secretaries and to the pensions from an official relationship as Member of the Federal Government or Parliamentary State Secretary of the Federation. The official salary and local allowance are still part of the official and pension payments; in this respect, the Federal Salary Act in the version valid until June 30, 1997 continues to apply.

The members of the Federal Government and the Parliamentary State Secretaries of the Federation receive their statutory remuneration in the form of the official salary and the local allowance only in the amount that was to be used on June 30, 2009. This official remuneration takes part in the general percentage adjustments to the salaries of federal civil servants in salary group B 11 that will take place after August 1, 2011.

According to this, a Parliamentary State Secretary receives 11,092.04 euros and 878.10 euros local surcharge,

Pay without this law

Without this law, the Federal Chancellor received an official salary of one-third and the Federal Ministers of one-third of the basic salary of grade B 11, including general allowances in addition to the basic salary . In addition, they receive a local allowance of one and third of the local allowance to which they are entitled in salary group B 11 as well as compensation for service expenses. The latter amounts to DM 24,000 annually for the Federal Chancellor and DM 7,200 for the Federal Ministers. According to this, the Federal Chancellor would receive an official salary of EUR 24,324.65 gross, and the Federal Ministers EUR 19,459.72. Changes

The law was most recently amended by Article 9 of the “Act on the Transfer of Marriage-Related Regulations in Public Service Law to Civil Partnerships”. In Section 1a sentence 2 of the Act, the second half-sentence was rewritten as follows.

Before that, Art. 10a of the Federal Salary and Pension Adjustment Act 2010/2011 ( BBVAnpG 2010/2011 ) of November 19, 2010 changed it. A paragraph 3 was added to Section 1 and the date July 1, 2009 was replaced by August 1, 2011 in Section 1b sentence 2.

Before that, it was amended by Art. 15 Para. 4 of the Service Law Reform Act ( DNeuG ) of February 5, 2009.

Before that, it was amended by Art. 5 Para. 4 of the Federal Salary and Pension Adjustment Act 2008/2009 ( BBVAnpG 2008/2009 ) of July 29, 2008.
