Legal basis

The legal basis for a trade register information is § 14 trade regulations (GewO). The competent authority is the trade or regulatory office of the municipality. Simple and extended business information

The competent authority provides simple information on the name, the business address and the activity of the respective trade on personal or written request.

The trade register must not be confused with the trade register, which is a subscription trap.

For the communication of further data from the trade register, proof of a legal interest is necessary according to § 14 GewO. An extended trade register information can be provided for the following information, if recorded:

  • Commercial register entry
  • legal form
  • Registration and deregistration dates
  • Branch (s)
  • Name, home address, date of birth of the manager (s)
  • Former company address, managing director, legal form, company (company name) and others.

Electronic business information

As an alternative to a written request to the relevant trade or regulatory office, there is the option of obtaining trade register information electronically (similar to information from the population register ). In 2007, the Second SME Relief Act created the corresponding legal basis in Section 14 of the GewO. The basic data of name, address and activity of a company can be made publicly available by the municipalities without a special interest in knowing this data being required. However, a legal interest is still required for further data from the trade register.

With the eAuskunft service, Berlin was the first city in Germany to provide online trade register information on the Internet. Here you can search for the basic data of the Berlin companies free of charge without prior registration. Instead of waiting an average of nine days for a written business report, users receive the data after two minutes via the e-report.

In particular, if you are unsure about the competence and procedures of an authority, you can turn to a private service provider who specializes in register information of this type.

On the other hand, electronic trade registers (eGWR) are now being developed or implemented in some federal states, which among other things also offer access to state-wide trade register information, for example the states of Saxony and Baden-Württemberg.
