Equal living conditions

The term equal living conditions is a political term. Since the German reunification , the creation of equal living conditions has been a declared political objective of the government of the Federal Republic of Germany.

With equivalent conditions of life today is, for example, meant that the transport projects (road construction and renovation) be accompanied by a strengthening of the business location in East Germany. Politics and society are discussing which basic services of general interest and which comprehensive basic services are to be guaranteed in order to create equivalent (not “identical”) living conditions .

When it comes to the objective of creating equivalent living conditions , one takes into account, for example, that the same infrastructure is not required in rural areas as in metropolitan areas, but that a basic infrastructure is available at all (this also includes the accessibility of centers for health care, for example).

According to Section 2 (2) No. 1 of the Regional Planning Act , “In the entire area of ​​the Federal Republic of Germany and its sub-areas [...] balanced social, infrastructural, economic, ecological and cultural conditions are to be aimed for. […] These tasks are to be fulfilled equally in metropolitan areas as in rural areas, in structurally weak as well as structurally strong regions. [...] We must work towards balancing spatial and structural imbalances between the regions. "

Origin of the term

The original version of 1949 in the Basic Law for the Federal Republic of Germany used the term “uniformity of living conditions”. Since the constitutional reform of 1994 in connection with German reunification , there has been talk of "equality of living conditions".

In certain areas of competing legislation ( Art. 74 Paragraph 1 No. 4, 7, 11, 13, 15, 19a, 20, 22, 25 and 26 GG) the federal government has the right to legislate if and to the extent that the establishment of equivalent living conditions in Federal territory or the preservation of the legal or economic entity in the national interest makes a federal regulation necessary ( Art. 72 Abs. 2 GG). This concerns the right of residence and settlement of foreigners, public welfare, the law of the economy, the regulation of training grants and the promotion of scientific research, the transfer of land, natural resources and means of production into common ownership or other forms of common economy, the economic security of hospitals and the regulation of hospital care rates, the right to food including the animals used for its production, the right to luxury foods, commodities and animal feed as well as the protection of the movement of agricultural and forestry seeds and plants, the protection of plants against Diseases and pests as well as animal welfare, road traffic, motoring, the construction and maintenance of country roads for long-distance traffic as well as the collection and distribution of fees or charges for the use of public roads with vehicles, state liability and d he medically supported generation of human life, the examination and artificial modification of genetic information as well as regulations for the transplantation of organs, tissues and cells.

The term first appeared politically and socially in 1975 in connection with regional planning law , which in turn is based on a draft law of 29 March 1935 on the “regulation of state requirements of the public sector”. It is about an even development of the sub-areas, especially with regard to services of general interest , income and employment opportunities.

Equal Living Conditions Commission

By cabinet decision of July 18, 2018, the federal government set up a Commission for Equal Living Conditions (KomGL). This commission was commissioned, on the basis of a common understanding of equivalent living conditions, to develop recommendations for action taking into account different regional developments and demographic change in Germany . To this end, the KomGL set up six specialist working groups:
