HAKOM

HAKOM ( Croatian Hrvatska regulatorna agencija za mrežne djelatnosti , German Croatian regulatory authority for network activities ) based in Zagreb is an independent national regulatory authority . It is responsible for carrying out regulatory and other duties within the scope of the business areas and corresponding responsibilities prescribed by the Law on Electronic Communications, the Law on Postal Services and the Law on the Regulation of the Railway Services Market.

history

HAKOM was established in mid-2008 by merging the then Croatian Telecommunications Agency (HAT) and the Council for Postal Services. In the course of 2014 HAKOM, the Agency for the Regulation of the Railway Service Market (ARTZU), was affiliated as an independent and independent regulatory authority established by the law on the Agency for the Regulation of the Railway Service Market. In this way, one of the most important requirements laid down in Directive 2001/14 / EC for the liberalization and functioning of the rail services market is met.

Establishment and administration

The founder of HAKOM is the Republic of Croatia, the founding rights are held by the Croatian Parliament (Hrvatski sabor) and the government of the Republic of Croatia. The activity of the HAKOM is public, for its work it is responsible to the Croatian Parliament. HAKOM is administered by the HAKOM Council. This consists of a total of five members and includes both the President and the Vice-President of the HAKOM Council. The President, the Vice-President and the members of the HAKOM Council are appointed by the Croatian Parliament on the proposal of the Government of the Republic of Croatia for a period of five years, and their replacement takes place in this way. The decisions of the HAKOM Council are made by a majority of the votes cast by the members.

The responsibility of HAKOM is:

  • the market regulation of electronic communications, postal services and rail services
  • the protection of end-user rights
  • the management of limited general goods of interest to the Republic of Croatia, d. H.
    • of the radio frequency spectrum
    • of the address space
    • of the numbering plan

As part of its supervision and the price and quality regulation of postal and electronic communication services, HAKOM has the task of protecting consumers. In addition, HAKOM ensures fair market competition by guaranteeing open and non-discriminatory action in the interaction between the owners of the infrastructure and the carriers. In addition, HAKOM supports the creation of an innovation-friendly environment in the telecommunications, postal and rail service markets and contributes to securing stable growth. In addition, HAKOM works to resolve disputes between users and providers of services in the area of ​​fees and the quality of services. HAKOM administers and controls the national radio frequency spectrum.

Structure and financing

HAKOM has a specialist department that carries out specialist, administrative and technical activities. The organizational structure is regulated in the statutes and in other basic legal regulations of HAKOM. The HAKOM specialist department is headed by a board appointed by the HAKOM council. The board of directors is responsible to the HAKOM council for its work. This state regulator for network activities currently employs 177 middle school and highly educated people. The total annual budget is around 10 million euros and is financed by fees for the administration of the address space, the numbering plan and the radio frequency spectrum as well as by fees as a percentage of the operator's total annual gross income.

International cooperation

HAKOM attaches great importance to good cooperation with neighboring countries and is also actively involved in the events of international authorities. HAKOM regularly takes part in numerous bilateral and multilateral conferences. This is intended to enforce the most efficient possible regulation of the market for electronic communication and postal services. The HAKOM is also involved in the work of working groups related to the market of postal services of the European Commission: ( COCOM Communications Committee), ERG (European Regulators Group), IRG (Independent Regulators Group), RSPG (Radio Spectrum Policy Group), RSC ( Radio Spectrum Committee), on the work of BEREC (Body of European Regulators for Electronic Communications) as well as ITU (International Telecommunications Union) and CEPT (Conférence Européenne des Régulateurs des Postes et Télécommunications). In relation to the postal services market, HAKOM participates in the work of CERP (Comité Européen des Régulateurs Postaux) and UPU (Union Postale Universelle). In the sector of the regulation of the uniform EC market for rail services with regard to the particularities of rail services, HAKOM works with national and European market regulators to coordinate the requirements and decision-making practice. HAKOM is also a member of the IRG-Rail (Independent Regulators Group-Rail), a forum of independent regulatory authorities on the EC rail service market.
