The ban on gambling addicts is a protective measure for those affected by gambling addiction and gambling , especially in arcades . It is about house bans in the form of self-blocking at the instigation of the gambling addict or his relatives.

Situation in Germany

In 2017 there were around 13,000 concessions for arcades in Germany and around five million regular and another five million occasional players.

The situation is mainly regulated by different state legislation.

As of 2018, the federal states of Baden-Württemberg, Berlin, Bremen, Hamburg, Hesse, Rhineland-Palatinate, Saxony-Anhalt and Schleswig-Holstein had legal regulations on player bans in gambling halls. The federal states of Bavaria, Brandenburg, Mecklenburg-Western Pomerania, Lower Saxony, North Rhine-Westphalia, Saarland, Saxony and Thuringia have no legal regulations. A distinction must be made between regulations for lock files for individual gambling halls and country-specific lock files.

  • In Hesse there are "cross-arcade player bans" based on a state-run blocking file called OASIS.
  • In Baden-Württemberg there is an entry control system based on biometric features (face recognition). Again, a biometric system is not allowed in Lower Saxony.
  • In Hamburg , Section 6 (6) of the Hamburg Game Hall Act stipulates that people with suspicious gambling behavior must be excluded from the game (“foreign bans”).
  • In North Rhine-Westphalia, the gambling addiction association, based in Bielefeld, took legal action against the company Casino Merkur Spielothek , a subsidiary of the Gauselmann Group , at the Hamm Higher Regional Court for enabling “self-locking” . The appeal against the decision of the Bielefeld Regional Court was rejected in 2018 (OLG Hamm, judgment of June 28, 2018, Az. 4 U 51/17).

Since January 1, 2020, due to the Third State Treaty on Gaming (3rd GlüÄndStV), it has been possible to block certain games of chance offered in state casinos ( roulette , slot machines, card games such as poker , blackjack, etc.) and the state-run games of chance Oddset , Toto, and Keno , as they are run more than twice a week.

There is still no comparable blocking system for the use of commercial slot machines in amusement arcades and in the catering sector. Those affected or third parties, such as relatives, are dependent on the assistance of the individual operators. An agreed house ban has no binding effect.

There is also the problem of illegal arcades.

The Federal Center for Health Education has set up an advice line. The state agency for gambling addiction in Bavaria and the state coordination agency for gambling addiction in North Rhine-Westphalia operate an advice line in Turkish.
