Central service regulation

A central service regulation ( ZDv ) is an internal, superordinate service regulation of the Federal Ministry of Defense , which is binding for all employees in its business area. Individual, for example armed forces- specific service regulations of the Bundeswehr must be distinguished from the central service regulations .

Most of these rules are as classified information classified "VS-RESTRICTED USE" (RESTRICTED) and is not available for reasons of confidentiality to the public.

Since the central service regulation "A-550/1 Regulungsmanagement" came into force on February 13, 2014, more and more regulations have been made available to the troops in digital form (as PDF files ) on the Bundeswehr's intranet .

As before, however, there is a regulation body for each unit, which keeps the majority of the regulations in printed form and updates them. Most regulations are available as gray plastic ring binders in DIN A5 or DIN A6 format and thus differ in color from other regulations such as the Army Service Regulations ( HDv , green) or the Technical Service Regulations ( TDv , brown). In some cases, however, regulations are also published as booklets. One example of this is the ZDv 10/1 Inner Guide , a colorfully illustrated paperback. At times, regulations were also issued on microfilm . However, this made access difficult because a reader was required to read, and it has largely been discontinued.

In addition to other documents, the Federal Archives also keep the military service regulations since the Prussian Army .

System of service regulations

The regulations are roughly categorized using the number before the slash (code number 1 to 99) (e.g. 14 / xx for laws or 20 / xx for personnel matters) and consecutively numbered with the number after the slash. Not all key figures are assigned. The list of central service regulations is itself a ZDv and classified as classified (ZDv 90/10).

Legal protection

Central service regulations cannot be challenged by individual soldiers in accordance with the Wehrbeschwerdeordnung (WBO), since the WBO does not provide for a general review of orders, decrees or administrative regulations of the Federal Ministry of Defense for their legality in the sense of a norm control procedure .

Central service regulations must, however, be compatible with superordinate statutory law.

A central service regulation is to be regarded as an “ order ” if the individual regulation in question requires the soldier to behave in a specific manner in the form of a specific command to be implemented or a specific prohibition to be observed. If an at least partially intentional violation of such a central service regulation leads to military service damage , this can result in an official liability claim by the injured party.
