Herbert Hemprich

Herbert Hemprich (born September 8, 1913 in Seehausen , Wanzleben district ; † April 28, 1985 in Oldenburg ) was a German Protestant church lawyer and from 1964 to 1981 senior legal counsel for the Evangelical Lutheran Church in Oldenburg .

Life

Herbert Hemprich studied law and political science at the Georg August University in Göttingen and in Berlin. He was a member of the Hannovera Göttingen fraternity . In 1938 he received his doctorate in Göttingen. From 1939 to 1946 Hemprich was in military service or in Soviet captivity. During his military service he was appointed Reichsbahnassessor in 1941 and appointed Reichsbahnrat in 1942.

In 1947 Hemprich switched to church service and began as a consultant in the provincial office of the EKD relief organization in Magdeburg. From 1950 he was consistorial councilor , from 1956 senior consistorial councilor of the ecclesiastical province of Saxony , each with responsibility for the legal affairs of the diocese of Magdeburg.

In 1957, in the intensified struggle of the SED regime against the churches , arrests and trials of the Consistorial President Kurt Grünbaum and the Chief Consistorial Councilor Dr. Siegfried Klewitz on account of the illegal importation of DM East from West Berlin into the GDR ( "money exchange process" ) under GDR law . The defense documents of the Diocese of Magdeburg in the proceedings that u. a. pointed out errors and omissions according to the GDR code of criminal procedure, made Herbert Hemprich, which was known to the Ministry for State Security , the State Secretariat for Church Affairs , the District Public Prosecutor and District Government Magdeburg. Bishop D. Johannes Jänicke and Hemprich presented the allegations of violation of applicable law to government agencies and ensured that the communities in the diocese made intercessions for the detainees. The district attorney's office in Magdeburg investigated Hemprich and considered taking him into custody; government agencies also meant that his children could neither graduate nor study. The family then left the GDR for West Berlin in 1958 after an exit application was approved surprisingly quickly.

From 1958 to 1964 Hemprich held the position of an administrative judge in Berlin (West). From 1964 to 1981 he was the legal senior church councilor of the Evangelical Lutheran Church in Oldenburg and representative of the bishop "in administrative matters, church regulations and legislation, personnel and salary issues, finances, church taxes". In this capacity, alongside Bishop Gerhard Jakobi, he was a participant in the first Ecumenical Discussion of the Ev.-Luth. Church in Oldenburg and the Episcopal Office of Vechta on January 8, 1966, which established the oldest ecumenical conversation tradition in Germany at church leadership level. From 1971 to 1979 he was sent by the Upper Church Council to the Council of the Confederation of Protestant Churches in Lower Saxony .

In the discussion about the church paper of the FDP from 1974 Free Church in the Free State , Hemprich advocated a factual handling of the paper by the churches and stated that some of the FDP theses were legally acceptable to the churches. Hemprich's stance comes from his clear affirmation of the separation of church and state in the sense of the church articles of the Weimar Constitution incorporated by Art. 140 Basic Law (Art. 137 ff.) While at the same time emphasizing their necessary partnership in society. For example, using the example of the church community and the political community, especially in the field of diakonia or Caritas, with all commonalities, he also developed something separating in the self-understanding of the Movens of the different bodies, namely the obligation to the common good of the political body of the community and the obligation to actively preach of the gospel of the church community in its relationship to God.

Hemprich was an honorary member of the Synod of the Church Province of Saxony from 1955 to 1958, later a member of the board of the Protestant hospital in Oldenburg and from 1968 to 1985 a member of the Hermann Ehlers Foundation .
