High Council of Justice

The High Judicial Council ( Albanian  Këshilli i Lartë i Drejtësisë , abbreviated KLD ) is a state authority in Albania which proposes the judges in the courts of first instance and in the courts of appeal to the president for appointment. He also has other rights and obligations.

The election of judges is regulated in the ninth section of the Albanian constitution . Article 147 regulates the main lines of the work of the High Judicial Council. An implementation law of May 17, 2001 determines the details. The official seat is in the capital Tirana .

Members

The High Council of Justice consists of twelve members who have a term of office of five years and meet at least once every two months.

In addition to the President of the Republic, who takes over the presidium, the members include the President of the Supreme Court, the Minister of Justice, three members of parliament and nine judges of all levels who are elected by the national judges' conference.

Duties and Powers

The High Council of Justice plays a crucial role in the practice of judges in the first instances and in the appellate courts. It is responsible for filling vacant positions by proposing candidates to the President of the Council. Furthermore, the council can initiate disciplinary measures against judges, change the place of work of the judges and transfer them.

The judges of the Constitutional Court and the Supreme Court are the only ones not nominated by the High Judicial Council, but approved by Parliament.
