The law for the acceleration of planning procedures for infrastructure projects is a German article law to simplify the planning procedures of large transport infrastructure projects.

When it came into force, the validity of the " Traffic Route Planning Acceleration Act " of December 16, 1991 , which was only valid for the new federal states , ended ( Federal Law Gazette I, p. 2174).

Regulations

The legislator hopes that the planning process will be shortened by more than two years through the following measures:

  • The Federal Administrative Court will be responsible in the first and last instance for a fixed list of major transport infrastructure projects.
  • Nature conservation associations are given equal status to private individuals in the planning process. Previous special deadlines and information obligations of the planning authority no longer apply.
  • Extended obligation for property owners to tolerate preparatory work.
  • Uniform validity of planning approval decisions of ten years (five more years on request).

Since the law came into force, according to the Federal Government, the option to forego a public hearing during the planning approval process has been used in 305 planning processes for federal transport routes (as of October 2010).

Emergence

The draft law was introduced by the federal government in November 2005. After a few changes, the Bundestag Committee on Transport, Building and Urban Development approved the draft after a controversial discussion on October 25, 2006. The representatives of the CDU / CSU and SPD voted in favor of the draft, those of the FDP, the Greens and the Left against. A proposal by the FDP also failed to find a majority, as was an amendment and a resolution by the Greens.

The law was passed by the German Bundestag on October 27th . On November 24, 2006, the Federal Council approved . It was promulgated on December 16, 2006 and came into effect the following day.
