The cantonal referendum «Abolition of the compulsory ballot box election for community vice-president resp. Community vice president » was a referendum in the Swiss canton of Solothurn , which took place on September 25, 2005. The content of the proposal was to let the canton's municipalities decide for themselves in future about the need for an election for the municipality's vice-president.

Background and content

In 2004, the Solothurn government council developed three measures to give the municipalities more autonomy with regard to the voting rights of their municipality. So the communities should be empowered in the future:

  • to introduce the right to vote for foreigners as an option for residents
  • maintain or abolish the compulsory ballot box for the municipal vice president
  • to optionally lower the voting and electoral age of the parishes to 16 years

Until now, the need for the election of the municipal vice-president was prescribed by the constitution of the canton of Solothurn . The governing council saw this practice as no longer appropriate and argued that:

  • more difficult conditions would apply to the office of community vice president than to the community president himself. In contrast to the mayor, applies to the municipality Vice President namely the requirement that this in the council must be. Since the municipal council members for their part already have to be elected by the people, it would take a total of two wins for the office of the municipal vice-president, while one can reach the municipal president with only one successful election.
  • a vacancy for the mayor's office during the term of office has usually resulted in two necessary elections. Since, as a rule, the community vice president moves up to become the community president - but still has to be elected - his position as vice president would become vacant and a second election would be necessary. In such a situation, the communities are faced with a double burden.

Despite this view, they did not want to forbid congregations to continue holding elections for congregational vice-president at their own request. For this reason, they wanted to remove only the relevant section (Art. 27 Paragraph 4b) from the cantonal constitution, so that the control of a necessary choice or not in the future of the municipal code is left to the municipalities.

Voting result

Seven out of ten districts accepted the bill. The approval ranged from 42% in the Thierstein district to 71% in the Solothurn district . As a cantonal average, the proposal was accepted with a participation of 52% and 55% yes votes. The canton's constitution, which was subsequently amended in a partial revision, came into force on November 1, 2005. The two other referendums that took place on the same day to increase the autonomy of the municipalities over the right to vote for people aged 16 and over and for residents were rejected.
