In Austrian motor vehicle law , a truck is all vehicles that are primarily designed and used for the transport of goods .

A truck is "a motor vehicle , wagon or a bicycle intended exclusively for the transport of goods ." ( § 2 Definitions Paragraph 1 Z 23 StVO i. D. 2019).

In general, a truck is therefore a truck  (truck), truck train (truck with trailer) or articulated vehicle .

The Higher Administrative Court has established in settled case law that it does not express that this legal qualification for motor vehicles or wagons requires an exclusive such provision, rather a predominant use is to be assumed. For this reason, for example, station wagons can also count as trucks in the sense of the road traffic regulations if they are used as such. However, this cannot apply to cars in general.

The wagons also include all vehicles with a design speed of 10 km / h .

When it comes to the term bicycle, it should be noted that according to the Motor Vehicle Act (Section 1, Paragraph 2a KFG 1967) and StVO (Section 2, Paragraph 1, line 22), electric bicycles and other electrically powered vehicles with a maximum output of 600 watts and a design speed of 25 km / h count, even multi-wheeled ones, while all more powerful auxiliary engines qualify the vehicle as a motorcycle , and thus as a motor vehicle.

Regulations

For trucks with "larger longitudinal dimensions", the requirement to keep a distance of at least 50 m from such a vehicle in front on open roads (Section 18 (3) StVO) applies in particular . The overtaking bans apply according to the StVO (regulation signs 4c / 4d) but only for trucks in the narrower sense (over 3.5 t), as well as night driving bans .

Furthermore, loading activities (as an exception to a no-stopping ban ) often only apply to trucks.
