The Max Planck Institute Luxembourg for International, European and Regulatory Procedural Law (German: Max Planck Institute for International, European and Regulatory Procedural Law , also for short: Max Planck Institute for procedural law ) in Luxembourg is a legal institute of the Max Planck -Society that started work in autumn 2012. It is fully funded by the Grand Duchy of Luxembourg . The institute is the first law institute of the Max Planck Society outside of Germany.

Research topics and structure of the institute

Subject of the institute are procedural law and "modern tendencies in dispute resolution", which are researched from different perspectives: from the perspective of international law, from the perspective of European and comparative civil procedural law and from the perspective of regulation, especially of financial markets.

The institute is accordingly divided into three departments: the Department of Public International Law, Department of European and Comparative Procedural Law and the Department of Regulatory Procedural Law, two of which are currently (as of September 2014) headed by directors. Burkhard Hess (previously Heidelberg) heads the department for civil procedural law.

External scientific members are Verica Trstenjak , University of Vienna, previously Advocate General of the EU, and the Italian-American lawyer and economist Marco Ventoruzzo .

The working language of the institute is English, the institute has a guest program and, since 2013, a "Working Paper Series".

Allegations of bullying and arbitrariness

The news portal Buzzfeed-News reported in February 2020 that there had been cases of mobbing and arbitrariness at the Max Planck Institute for Litigation. An internal survey by the staff representatives showed that 23 percent of the employees at the institute had already experienced "psychological harassment or bullying"; 37 percent of the employees stated that they had already witnessed such incidents. As a result of the report, the Luxembourg trade union OGBL demanded intervention by the Luxembourg Ministry of Research and also criticized a confidentiality clause in the institute's employment contracts, which violated Luxembourg labor law.

Compared to the Frankfurter Allgemeine Zeitung , which reported on the occurrences on March 13, 2020, the management of the institute explained that new employees would be particularly advised to "maintain a correspondingly attentive and respectful treatment in an international institute due to the different cultural backgrounds" . The Max Planck Society explained to the newspaper that "the directors and the administrative board agreed that further measures were needed to improve the situation at the MPI for all employees in the long term".

According to the Luxembourg online portal Reporter.lu, the Max Planck Society decided in March to initiate a formal investigation into the allegations, which particularly concern the director Hélène Ruiz Fabri.

International Max Planck Research School

The institute is the sponsor of the International Max Planck Research School for Successful Dispute Resolution in International Law , which is organized jointly with Heidelberg University and the Heidelberg Max Planck Institute for Comparative Public Law and International Law .
