Michael Köhler (lawyer)

Michael Köhler (born May 21, 1945 in Heidelberg ) is a German legal scholar .

Michael Köhler spent the post-war period with his grandparents in Switzerland. He passed his Abitur in 1964. He studied law first in Heidelberg and then in Munich. Ernst Amadeus Wolff was one of his academic teachers . The state exams followed in 1968 and 1972. He is completing his legal clerkship in Baden-Württemberg. In 1972 he passed the assessor exam. In the same year he received his doctorate with a thesis supervised by Götz Landwehr on the subject of the right of resistance in the German constitutional theory of state law of the first half of the 19th century . Köhler was a research assistant at the law faculty of the University of Heidelberg with Wilfried Küper. In 1978 he completed his habilitation in the subjects of criminal law , criminal procedure law and legal philosophy with the thesis “The conscious negligence ”. Köhler taught as professor at the University of Heidelberg in 1980 and at the University of Cologne in 1982 . From 1983, until his retirement, Köhler taught as professor for criminal law, criminal procedure law and legal philosophy at the University of Hamburg . Until his retirement in 2010, Köhler was also managing director of the seminar for legal philosophy. In 2006 he was elected a full member of the Academy of Sciences in Hamburg .

His main research interests are the general part of criminal law and the philosophy of law, in particular the application of the principles of legal philosophy to positive law, the updating of the tradition of legal philosophy and the theory of justice . He dealt in depth with fundamental questions of criminal law, including the justification of the punishment, the general teachings of the crime and the theory of legal consequences. In 1997, his highly regarded textbook on the general part of criminal law was published. Köhler made repeated comments on questions of criminal procedure. Questions of drug and medical law prompted Köhler to be involved in the ethics committee of the Hamburg Medical Association for many years .

In 1996 he complained to the Federal Constitutional Court against the fact that the BND eavesdropping on telecommunications with foreign countries for key words.
