Detention , silence or rework , depending on the federal state, is an educational or regulatory measure that is imposed on a student , for example because of bad behavior or comparable school offenses. Anyone who has to detain may z. B. not home with the other students, but has to stay a certain time in school and do additional tasks. Detention is considered one of the mildest educational or regulatory measures. In the case of underage students, parents must be informed in advance.

Germany

In Germany detention is regulated in the school laws of the federal states:

The school law of the state of Baden-Württemberg stipulates that detention of up to two lesson hours can be ordered by the teacher . Detention for up to four hours must be ordered by the school principal.

In Schleswig-Holstein , the school act regulates culpably missed lessons after notifying the parents in advance.

In Rhineland-Palatinate , detention is not permitted as an educational measure.

In Bavaria , follow-up work under the supervision of a teacher is an educational measure if the pupil does not participate sufficiently in the class (Art. 86 para. 1 BayEUG). In accordance with Section 16, Paragraph 3 of the School Regulations for Gymnasiums (GSO), it is set in writing with a separate appointment.

In North Rhine-Westphalia , follow-up work under supervision is provided as an educational measure after prior notification of the parents . A music teacher at a secondary school in Neuss was convicted of deprivation of liberty on August 24, 2016 , because he had forced a class in which there had previously been repeated disruptions to teaching to stay in the room after the end of classes and copy a Wikipedia article. One of the students then called the police with his mobile phone. The teacher received a warning with reservation of punishment as well as the requirement to receive further training in dealing with undisciplined students. The judgment was overturned in the second instance and the teacher in question was acquitted.

In Hamburg, it is permissible to make up for lessons that have been culpably missed after notifying the parent or guardian .

In Saxony , rework is not regulated in the School Act and may fall under other educational measures in contrast to regulatory measures (cf. § 39, Paragraph 1, School Act).

In Hesse, it is permissible to make up for lessons that have been culpably missed after notifying the parents in advance. Schools can, however, exclude detention as a measure in their school regulations.

Austria

Detention as a punishment is prohibited by law in Austria.

However, it is allowed if students have to catch up on tasks or exercises that they could not do in class. However, these tasks only have to be done at school if they cannot be done at home. That means, in a way, detention is made possible through the back door.

Detention as a theme in the feature film
