Nikolaus Berger

Nikolaus Berger (born January 9, 1956 in Mühlhausen / Thuringia ) has been a judge at the Federal Court of Justice since April 1, 2009 .

Berger passed his Abitur in 1975 at the Wilhelm-Gymnasium (Braunschweig) . He studied law and ethnology at the Georg-August-Universität Göttingen until 1983. Then, parallel to his legal clerkship , he was a research assistant at the seminar for commercial, shipping and economic law at the University of Hamburg (Chair Karsten Schmidt ). There he was in 1988 with a thesis on the type and legal nature of leasing manufacturers to Dr. jur. PhD. In the same year he entered the higher judicial service of the Free and Hanseatic City of Hamburg. In 1990 he was appointed judge for life at the Hamburg Regional Court according to § 10 DRiG . From 1991 to 1993 he was press spokesman for the Hamburg judicial authority. Afterwards he was on leave until 1995 and during this time he was a scientific advisor to the SPD parliamentary group in the inquiry committee of the Schleswig-Holstein state parliament on the so-called drawer affair .

After resuming his professional activity as a judge, Berger was appointed presiding judge at the Hamburg Regional Court in 2003. He became known to a wider public as the presiding judge in the criminal proceedings against the publishing heir Alexander Falk .

On April 1, 2009, Berger was appointed judge at the Federal Court of Justice and assigned to the 10th Civil Senate . At the same time, Berger was a member of the Xa civil senate , a so-called auxiliary senate in the field of patent law, until the end of 2009 . In addition, he held the office of Investigative Judge V at the Federal Court of Justice from April 2009 to June 2013. On February 1, 2011, he moved to the 2nd criminal division and on July 1, 2013 to the fifth criminal division in Leipzig . Since May 2020 he has been deputy chairman of the 5th Criminal Senate.
