Chamber of Notaries (Estonia)

The Chamber of Notaries of the Republic of Estonia (Estonian Notarite Koda ) is a chamber of notaries in Tallinn . It is a legal entity under public law , established in accordance with the Notaries Act with the aim of uniting notaries . Members of the chamber are all appointed notaries. The activity of the Chamber of Notaries is regulated by the Notaries Act and the Statute of the Chamber of Notaries.

The highest organ of the Chamber is the Representative Assembly of the Chamber of Notaries and the executive organ is its Presidium .

The Estonian Minister of Justice is responsible for overseeing the Chamber of Notaries . Seven members are elected to the Presidium of the Chamber of Notaries by the Assembly of Representatives for 3 years.

Number of notaries: 100; Number of notary assessors : 24 (as of 2009).

tasks

The main tasks are:

  • Representation and protection of the common professional interests of notaries;
  • Standardization of the practice of notarial authentication and coordination of the official activities of notaries;
  • Assistance in the application of measures for the proper and dutiful fulfillment of the tasks of the notaries;
  • Raising the qualifications of notaries and organizing the training of notary assessors and office workers;
  • Participation in the supervision of notarial activities and control of compliance with the ethical requirements of the notarial profession.

The Presidium of the Chamber of Notaries ensures compliance with the statutes and the implementation of the resolutions of the representative assembly. The meetings of the Presidium take place at least once a month.

With some significant changes, the laws of Tsarist Russia applied to the notary's office in Estonia until the occupation of the Estonian Republic in 1940. On the basis of the above-mentioned law, the Minister of Justice issued an ordinance on April 11, 1919 - Instructions for notaries, with the one in Estonia 39 notary posts were created. In 1940 there were already 48 notary offices in Estonia. In Estonia from 1918 to 1940, the Latin model of the notary was in use: the notaries were civil servants in the Ministry of Justice, but they were not paid from the state treasury and were liable with all their property. A deposit was provided to compensate for the damage incurred. Failure to pay this could remove the notary from office.

The Chamber of Notaries began its work on November 1, 1993 when the Notaries Act came into force.

The Chamber of Notaries of the Republic of Estonia has been a member of the International Union of Latin Notaries ( UINL ) since 1995 .
