The Austrian Compulsory Deposit Ordinance (abbreviated PflAV ) is decreed by the Federal Chancellor and regulates the obligation of publishers to deliver and offer media works (especially printed works) to the Austrian National Library and the libraries of the federal states . The Media Act (MedienG) is the main basis for the regulation .

The compulsory deposit ordinance that came into force on August 27, 2009 replaces the ordinance of the Federal Minister of Justice of December 4, 1981 on the delivery and offering of library items in accordance with the Media Act from 1981, as well as the ordinance of the Federal Chancellor on the obligation to offer and deposit other media works according to the Media Act from 2001 and brings them together in an ordinance.

Printing units

Section 1 of the PflAV regulates the obligation to submit periodic and other printed works (e.g. books, magazines, etc.). This is based on § 43 MedienG. According to this, depending on the place of publication, a printed work must be delivered to two libraries in the federal state in which it appears and in any case to the Austrian National Library. Furthermore, every printed work must be offered to the parliamentary library and the federal administrative library for acceptance or purchase.

In Section 5 of the PflAV, most small print units are exempted from this obligation.

Other media works

For other media works (websites, computer games, etc.), the Media Act also specifies obligations to deliver and offer, which are specified in the mandatory deposit ordinance.

Authorities and criminal provisions

Pursuant to Section 45 of the Media Act, the relevant district administrative authority or, for municipalities for which the State Police Department is the 1st instance security authority, the State Police Department is responsible for enforcing the provisions . It can administrative fines up to 2,180 euros be imposed.
