Rudolf Isay

Rudolf Isay (born January 1, 1886 in Trier , † April 14, 1956 in Bonn ) was a German lawyer , patent attorney and cartel specialist.

Professional background

Isay studied from 1904 Law and received his doctorate in 1908 at the University of Bonn. From 1911 he worked as a patent attorney in the office of Eduard Reimer and his brother Hermann Isay and was admitted to the higher court . Because license agreements were regularly used to form cartels (patent exploitation associations) at the time, the work of a patent attorney included not only the patent system but also the related drafting of cartel agreements. During the Weimar Republic , Isay rose to become one of the most important commercial law firms in the capital city of Berlin.

In the Nazi state , the Isays brothers were discriminated against and were banned from practicing their profession because - although not religious - they were racially Jews according to their origin and therefore for the authorities. Due to the ongoing problems, Rudolf Isay emigrated to Brazil with his wife Isabella Trimborn in 1935 and worked as a coffee planter and cattle breeder in the German settlement of Rolândia until 1951 .

Six years after the end of the war he returned to Germany and taught until 1956 as a professor of law at the University of Bonn .

effect

Rudolf Isay was a prominent academic representative of the German cartel movement of the 20th century. He specialized in patents (important for technology cartels ). In the 1950s he became a prominent representative of a competition regime with general approval of cartels. Isay had the advantage of not being politically burdened by his emigration, whereas most of the German cartel supporters were either sympathizers of National Socialism or somehow had to come to terms with the regime. The still existing German cartel movement consequently liked to adorn itself with Isay.

However, its economic policy orientation - due to the decartelation ordered by the Allies - was ultimately lost after 1945.
