Litigation with Apple
On August 9, 2011, Apple obtained an injunction against the German subsidiary of Samsung at the Düsseldorf Regional Court , which initially prohibited the sale of the Galaxy Tab 10.1 in the European Union (except for the Netherlands ) (file number: 14c O 194/11). Apple accuses Samsung of imitating the protected design of the iPad and thereby exploiting the “cult status” of Apple's competing product. The ruling was restricted to Germany on August 16, 2011 by the regional court. On September 9, 2011, the Düsseldorf Regional Court confirmed that Samsung Germany is not allowed to sell its tablet PC model. For Samsung Germany, this sales ban applies throughout Europe, the court ruled. Samsung has appealed against the Düsseldorf judgment, but an oral appeal hearing should probably only take place in 2012.
The proceedings in Düsseldorf are part of a global conflict between the two major corporations. According to the patent expert Florian Müller, there are currently (as of September 2011) 23 lawsuits pending worldwide. The Düsseldorf ruling has no serious effects on the availability of the devices in Germany. The German subsidiary of Samsung is prohibited from bringing the device onto the market. However, the South Korean parent company Samsung International still has the option of delivering devices to Germany. For example, the white Galaxy Tab 10.1 was offered for immediate sale in Germany in September 2011 by over twenty online shops based in Germany.
On November 17, 2011, Samsung released a version of the tablet specially modified for Germany called the Galaxy Tab 10.1N . According to Samsung, this should no longer violate the design of the predecessor objected to in the judgment by the Düsseldorf Regional Court . On November 30, 2011, Apple also applied for an injunction against the modified version of the tablet (Galaxy Tab 10.1 N) at the Düsseldorf Regional Court. On February 9, 2012, the Düsseldorf Regional Court rejected Apple's application to prohibit the sale of the device in the Federal Republic of Germany. The modified design compared to the previous model differs sufficiently from the iPad, even if the design is based on the iPad, according to the court.
In the United States , Apple and Samsung also fought a lawsuit over the Galaxy Tab 10.1. After Apple obtained a nationwide import and sales ban for the tablet in June 2012, it was lifted again at the beginning of October. In the opinion of the court, the device did not infringe Apple's cited design patent.
