State Council (Belgium)

The Belgian Council of State ( Dutch Raad van State ? / I , French Conseil d'État ) is the advisory and judicial body within the executive power in Belgium . It is based in Brussels . Audio file / audio sample

The Belgian Council of State offers all natural and legal persons an effective remedy against unlawful official acts for which no other judicial body is competent. As a result, the main task of the State Council is to suspend and / or annul the performance of official acts ( acts and regulations ) that violate the norms in force . In this context, the Council is also an advisory body with regard to the adoption of legislation. The State Council makes judgments on the complaints and motions submitted.

Its composition, responsibilities and working methods are determined by law. The State Council is composed of:

  • the auditor,
  • the coordination office,
  • the firm and
  • the administrative staff.

Due to the tasks assigned to it, the Council of State is divided into a legislative department and an administrative department.

The Council of State also publishes documents in German, French and Dutch that are important for law seekers and legal practice.

The Belgian Council of State was established by law as an extrajudicial judicial body on December 23, 1946 and solemnly installed on October 9, 1948 . According to the constitution of the federal state, it applies to all of Belgium.
