Professional representation

Professional organizations (often also corporation , chamber or association called) represented academic professions (including the liberal professions) in the form of an own professional organization. They are organized either as a professional body under public law or under private law. However, the term professional corporation is unusual.

In the legal form of a corporation under public law (Germany) , they simultaneously perform sovereign tasks and are responsible for professional matters as self-governing organizations that are subject to the legal supervision of the responsible ministry. As the competent chambers, they formulate the professional code of conduct . The professional associations also fulfill legislative functions by formulating the professional law . At the same time, they represent interests and exercise an advisory role to the legislature. The content of the liberal professions is generally based on special professional qualifications or creative talent, the personal, responsible and professionally independent provision of services of a higher kind in the interests of the client and the general public. Their exercise is regulated by the supervision of the professional representatives.

For some of the above-mentioned stands, the fee is set by the relevant stand representatives in a fee schedule. These are issued either as an ordinance by the administrative authority or as a statutory ordinance by the federal government with the consent of the Federal Council and (rarely) adapted to the changing conditions. The regulation is intended to avoid arbitrariness in accounting.

Representation of interests and advisory functions vis-à-vis the legislature characterize the corporations under private law , which mostly operate in the form of a registered association .

In addition to the organization of these professions, professional bodies also formulate the professional code, the designation of the profession and its self-administration, especially in the case of the liberal professions.
