Foundation & Co. KGaA

The Stiftung & Co. KGaA is a partnership limited by shares (KGaA), whose general partner is a foundation is. By choosing this hybrid form, the limited partnership's liability can be limited to shares without having to give up their legal form . The limited partners of this company are also called limited partners.

The management is provided by the foundation board. This is appointed by the foundation, not by the limited partners.

The Stiftung & Co. KGaA is a relatively young form of company, which, like the GmbH & Co. KGaA or the AG & Co. KGaA, owes its existence to a judgment of the Federal Court of Justice in 1997.
