Collective agreement on measures to accompany the restructuring of the Brandenburg state administration

The collective agreement on measures to support the restructuring of the Brandenburg state administration (TV conversion) was concluded in 2008 between the Brandenburg state government and the ver.di , GEW , GdP , dbb tarifunion and IG BAU trade unions for the Brandenburg state administration. The collective bargaining agreement has been in effect since January 1, 2009. It was terminable for the first time with effect from December 31, 2012.

The aim of the collective bargaining agreement is to increase the flexibility and mobility of employees in the state service in light of the downsizing decided by the Brandenburg state government (see also personnel requirement planning in Brandenburg ). In return, dismissals for operational reasons are excluded. The collective agreement applies to around 25,000 employees.

Essential content

The TV conversion contains regulations that have exemplary character in the Federal Republic. According to Section 6 of the collective agreement, employees receive a mobility bonus if they continue to be employed outside of their previous place of work or residence. The amount of the mobility premium depends on the distance. It is paid for 18 months.

In addition, the TV conversion grants temporary classification protection (Section 7, Paragraphs 1 and 2) and, after the classification protection has expired, contains provisions on the preservation of vested rights (Section 7, Paragraphs 3ff). The employees' claim to job security anchored in Section 3 (2) TV conversion must be implemented by the state government in such a way that alternative jobs are to be sought for employees affected by conversion in accordance with a cascade anchored in Section 4 TV conversion.

Section 17 of the collective agreement contains special regulations for teachers at general and vocational schools in the State of Brandenburg. For employees within the scope of the forest collective agreement (forest workers), the regulations in Section 18 must also be applied.

The TV conversion also grants employees the right to further training if this is necessary in order to accept a new job within the state administration. In addition to one-year further training measures that the state of Brandenburg has to offer as an employer, longer retraining measures can also be offered. At present, middle-class employees are being trained for higher-level service at the Brandenburg State Academy for Public Administration in Königs Wusterhausen ("Quit" course) and other employees are completing a technical college degree as computer scientists at the Harz University of Applied Sciences in Wernigerode .

Bodies

A clearing house has been set up to resolve disputes regarding the interpretation of the collective agreement (Section 19 (4)).

An advisory board has been set up to support the renovation process in the Brandenburg state administration ( advisory board in accordance with TV conversion ). The advisory board consists of five ministers and representatives of the five unions that signed the collective agreement.

The advisory board meets two to three times a year. In it, the planned and ongoing central renovation projects are politically discussed with the trade union representatives.

The meetings of the advisory board are prepared by a joint working body with the trade unions ( GAG ). Five representatives of the state administration and five union officials belong to the GAG. The committee meets every six to eight weeks under the chairmanship of the head of the administrative modernization department in the Ministry of the Interior, Volker-Gerd Westphal. The GAG ​​provides detailed information on reform projects in the Brandenburg state administration (e.g. police reform, bundling of tasks and personnel).
