Succession to the throne (Luxembourg)

from Wikipedia, the free encyclopedia

The succession to the throne in the Grand Duchy of Luxembourg is regulated by the constitution of July 9, 1848.

Article 3 of the constitution reads: “The crown of the Grand Duchy is hereditary in the Nassau family , in accordance with the Treaty of June 30, 1783, Article 71 of the Vienna Treatise of June 9, 1815 and the Treaty of London of June 11 , 1783 . May 1867. "

"In the absence of a further statutory provision, the right of succession to the throne in Luxembourg is, as stated in common German law, the agnatic succession (Salian right of succession only from man to man), whereby only in the absence of a male heir to the throne within the existing grand ducal house female succession to the throne, then immediately becomes agnatic again in the new grand ducal house. If a Grand Duke only has daughters, he will be succeeded by his brother, the brother of his father or his grandfather or great-grandfather on the paternal side (provided that they are descended from the ruling Grand Duchess who founded the new grand ducal house) and only when all male members of the The eldest daughter of the last reigning Grand Duke and, in the absence of this, her brother's daughter and, in the absence of such, the sister of the last Grand Duke, is entitled to the succession (female succession to the throne in the event of male line extinction according to the pragmatic sanction ). "

By a decree of Grand Duke Henri, the succession to the throne for his descendants was changed to the effect that “[...] in the event of the death or abdication of a ruling Grand Duke, the right of succession to the throne is no longer limited to the male line alone, but rather the right [is] to introduce, confirm and affirm the firstborn regardless of gender, so that the line of succession to the firstborn child of a ruling Grand Duke should and should remain. "
