Constitution minister

The constitution minister is the head of a ministry at the state or national level that oversees the safeguarding of the constitution and the constitutional rights of citizens. In Germany the office is exercised by the Minister of the Interior and the Minister of Justice .

The constitution minister is responsible for examining all legislative projects of the federal government or individual federal ministries for their compatibility with the Basic Law . In addition, there are questions of the Bundestag and European electoral law , party law , public association law, the right of assembly , European Union law , constitutional law with reference to international law, and administrative and administrative procedural law . The legal basis for this is Section 26 (2) of the Federal Government's Rules of Procedure. According to this, the Federal Ministers of the Interior and the Justice have the right to object to measures by the Federal Government if the measure is not compatible with applicable law. However, the provision has only organizational character. Because a binding of the federal government to the constitution results from Art. 1 Abs. 3 Grundgesetz .

The post is established in the governments of both the federal states and the federal government . In the city-states with a Senate constitution ( Hamburg , Bremen and Berlin ) the constitution minister is called the “Senator of the Constitution”.

The constitution minister, like any other minister , is responsible for his department , but is subject to the head of government ( Federal Chancellor or Prime Minister ) due to the latter's authority to issue guidelines .
