Elements of the marking on a flour package

The Food Labeling Ordinance ( LMKV ) in Germany regulates the labeling of food that is delivered to the end consumer in prepackaged items . It was lifted on July 13, 2017. Since then, only the provisions of the Food Information Ordinance apply . However, the German legislator has determined that the regulations remain applicable to various areas.

Content overlaps with the LMIV

The directly applicable Food Information Regulation (LMIV) for the labeling of prepackaged foods has been in force across the EU since December 13, 2014 . However, due to the lack of formal repeal, the LMKV was still a valid national statutory ordinance until 2017. The LMKV should be repealed as soon as the LMIV comes into effect and replaced by the Food Information Implementation Ordinance (LMIDV). However, the LMIDV did not come into force until July 13, 2017. The first national regulations were previously created with a provisional food information supplement regulation. With the LMKV and the LMIV, there were therefore temporarily two different legal norms that have largely the same regulatory content. Due to the effective nature of European regulations, however , the LMKV was de facto no longer applicable to matters that are directly regulated by the LMIV. This solution is also suggested by the wording of Section 1 (3) No. 9 LMKV (“ The provisions of this regulation also do not apply to the labeling of (...) foodstuffs, insofar as their labeling in regulations of the Council or Commission of the European Union is regulated ").

In November 2011, the EU LMIV was announced in the Official Journal and has been mandatory in all EU member states since December 13, 2014 . Exceptions are the nutritional labeling (mandatory from December 13, 2016, Article 54 para. 1 subpara 2 LMIV) and the "special requirements for the designation 'minced meat'" (applies since January 1, 2014, Article 54 para 1 UA 3 LMIV).

  2. the name or company and the address of the manufacturer, packer or distributor
  3. the list of ingredients (in descending order of their proportions by weight at the time of their use in production - without specifying the quantity)
  4. Quid rule - quantity is required if an ingredient is particularly emphasized by word or picture
  5. the best before date or, in the case of microbiologically perishable foods, the use-by date
  6. the quantities / filling quantity

Since November 25, 2005, certain allergens in food have to be labeled in the EU . See allergen labeling .
