The Provisional Tobacco Law of the Federal Republic of Germany contained provisions relating to tobacco products. The law was passed in 1974 as the Food and Consumer Goods Act ( LMBG ). The LMBG was the legal basis for the processing and placing on the market of food and substances that come into contact with food. With effect from May 20, 2016, it was replaced by the Tobacco Products Act.

With the publication of the law on the reorganization of food and feed law in the Federal Law Gazette, the LMBG was almost completely replaced by the food, consumer goods and feed code on September 7, 2005 . Only regulations on tobacco products remain in place. Since September 1, 2005, the new title of the law is Provisional Tobacco Law .

The food and consumer goods law largely determined German food law. For law many are regulations and administrative provisions adopted. In addition to consumer protection , the aim was also to protect against dangerous (contaminated) foodstuffs and consumer goods; in addition, there was considerable interference in trade law . Modified foods are those that have been treated pharmacologically (e.g. hormonally), sprayed with inadmissible pesticides, irradiated with ionizing or ultraviolet rays in an inadmissible manner or with inadmissible additives. In addition to tobacco products, cosmetics were also restricted.

The LMBG ordered the implementation of monitoring of food traffic along the value chain for food and monitoring of the ingredients. The monitoring focused on heavy metals, pesticides and mycotoxins to ward off health hazards. This is largely reflected in the LFGB.

The Provisional Tobacco Act provided for in Sections 51, 52 criminal provisions for violations of federal law and in Sections 56, 57 criminal provisions for violations of European law. Thus the VTabakG belonged to ancillary criminal law .

The advertising bans embodied in §§ 21–22a VTabakG were of particular importance .
