The Housing and Participation Act (WTG) in North Rhine-Westphalia represents an essential part of the implementation of the 2006 federalism reform in the area of ​​home law. The Federal Home Law is thus completely superseded for the area of ​​application of the state of North Rhine-Westphalia and replaced by the WTG NRW (§ 49 para. 2 WTG NRW).

When the federalism reform came into force in 2006, the federal government's legislative competence in residential law was transferred to the federal states despite violent protests from many specialist agencies. North Rhine-Westphalia was the third federal state after Baden-Württemberg and Bavaria to replace the federal home law in its area . Nationwide regulations continue to apply to the home contract , now regulated in the Housing and Care Contract Act (WBVG).

In addition to the State Home Act , North Rhine-Westphalia has partially replaced the previous nationwide regulations on the Home Act with a simultaneously issued implementing ordinance (WTG DVO).

The North Rhine-Westphalian state government under Minister of Social Affairs Laumann presented an amendment to the law at the end of 2018, which, among other things, was intended to reduce the regulatory privileges of new forms of living such as community-assisted residential communities. Following protests from interest groups for these types of housing, the draft law was revised. The amendment was passed in the state parliament in April 2019.
