Wolfgang Meyer (born December 31, 1947 in Dortmund ) is a German lawyer and was a judge at the Federal Social Court from 1987 to 2013 .

Life

In 1987 he became a judge at the Federal Social Court and from 1996 was chairman of the 4th senate responsible for pensions . During his time in the 4th Senate, his Senate ruled, among other things, on pension claims of GDR academics, engineers or scientists, former Reichsbahnern and postal workers of the GDR. In 2007 he was replaced as presiding judge of the 4th Senate. He was then chairman of the 2nd Senate of the Federal Social Court, which is responsible for accident insurance . He retired in 2013.

Meyer is honorary professor at the University of Bochum .

Dispute over transfer to the 2nd Senate

Wolfgang Meyer had been advising the Presidium for a long time that the 4th Senate for pension law, which he presided over, was overburdened. From 2007 new entries on pension law were submitted to 5a, which is also responsible for the subject matter. Assigned to the Senate. According to the court's distribution plan of April 1, 2008, the 4th Senate was no longer responsible for pension matters. Wolfgang Meyer took the view that the transfer from the 4th Senate was due to political pressure. His judgments have become too costly for the insurance carriers. The Federal Social Court rejected the allegations. The transfer had no personal reasons, he himself reported an overload. An eight-person panel of judges was involved in the process, all of which would then have to decide to please the pension insurance. The transfer was criticized.

In June 2008, he brought an action against his transfer from the 4th Senate to the Administrative Court of Kassel and to the Federal Constitutional Court for encroaching on judicial independence . With a decision of June 12, 2008, the Federal Constitutional Court did not allow the constitutional complaint because legal action had to be exhausted first. The administrative court dismissed the action on April 28, 2009. The decision under the file number 1 K 691 / 08.KS was based on the inadmissibility of the action - an objection procedure had not been carried out. Since the attacked business distribution plan no longer had any validity, there was no longer any interest in establishing that Meyer had not submitted sufficient evidence on the violation of judicial independence. Such an action by a judge at a federal court is so far unique.
