Anchor tenants

The anchor tenants , including anchor-business (of English. Anchor tenant ) is a main or large users within a commercial property. The term is common throughout the German-speaking area and is preferably used in connection with retail properties and shopping centers , where the anchor tenant attracts the largest number of customers for the entire property.

Economic importance

The anchor tenant has an above-average attraction for customers and is therefore also referred to as a magnet business . The positioning within the property plays an important role, because the other, smaller shops benefit from the attraction of the anchor tenant. The typical mall , which consists of a shopping arcade with smaller shops between two anchor tenants, goes back to the idea of Victor Gruen . The Urban Entertainment Center is a further development .

From an economic point of view, the anchor tenant (in the case of larger centers, several) ensures the highest customer frequency . Also due to the mostly large rental area , the rents of anchor tenants are comparatively low, so that the economic benefit for the owner is mainly generated from the other rental areas. These tenants develop their function as anchors z. B. at the end of a long row of shops, where the (worse) location also justifies the lower rent. In the case of new projects, the anchor tenant must first be tied, as the layout and occupancy of the remaining space ( branch mix ) is based on him. Anchor tenants are often large department stores, electronics stores or large textile retailers, and often even as investors in the projects.

The anchor tenant is therefore also a weak point in the economy of a shopping center. The move of an anchor tenant can quickly lead to the other tenants also moving away due to insufficient customer frequency ( dead mall ), that the income does not cover the costs or that a new anchor tenant has to be tied at short notice (often at unfavorable conditions for the center), to avoid the effects mentioned. Therefore, an anchor tenant may put pressure on the center's management to achieve its own goals.

Competition law

According to a ruling by the European Court of Justice on November 26, 2015, a lease that restricts the landlord's right to enter into other commercial leases with potential competitors of the anchor tenant without the anchor tenant's prior consent may be anti-competitive. A violation of the prohibition of cartels in Art. 101 TFEU only exists if a detailed examination of the economic and legal context shows that the contractual clause in question contributes significantly to the foreclosure of the market.
