Antonio Luis Baena Tocón

Antonio Luis Baena Tocón (1915-1998) was a Spanish civil servant and officer who served in several military courts under the dictatorship of Francisco Franco in the years following the Spanish Civil War . He is best known for his position in the court that sentenced the poet Miguel Hernández to death in 1940 .

biography

Between 1939 and 1943, Baena Tocón served with the rank of ensign at the Special Court for the Press, which was responsible for the prosecution and cleansing of people who had been active as a journalist during the republic . Under the orders of the examining magistrate, he was given the task of doing research in the Madrid Municipal Newspaper Archive and recording the names of writers and journalists, along with notes on alleged offenses in their works.

He was also a member of several military tribunals related to the Special Court for the Press, in particular the one that sentenced the poet Miguel Hernández to death in March 1940, which sentence was later commuted to a 30-year prison term. Baena Tocón acted as the court's secretary, although he did not have the required qualifications as he had only completed a few law courses.

In June 1966, Baena Tocón was appointed chartered accountant with the Córdoba City Council, a position he held until his retirement. Before that, he became the provincial council's deputy inspector. Both positions, as is customary in the dictatorship, were given to those who were loyal to the regime.

In June 2019, at the request of his son , the University of Alicante removed all indications in the digitized archives of Antonio Luis Baena Tocón's participation in the trial against Miguel Hernández . This created a Streisand effect that drew media attention to the matter.
