Augusto Pierantoni

Augusto Pierantoni (born June 24, 1840 in Chieti , † March 12, 1911 in Rome ) was an Italian lawyer and politician . Among other things, he worked as a professor at various Italian universities and as a senator . In addition, he was involved in founding the Institut de Droit international (Institute for International Law) in 1873 .

Life

Augusto Pierantoni was first Ministerial Secretary in Turin and later Professor of Constitutional Law and International Law at the Universities of Modena (from 1865), Naples (from 1871) and Rome (from 1876). In addition, he became a member of the Italian Senate in 1883. In 1885 he represented his home country at the Paris conference on navigation in the Suez Canal .

Together with ten other lawyers from different countries, he founded the Institut de Droit international (Institute for International Law) in the Belgian city of Ghent in September 1873 . The aim of this institution, which has existed to this day and was awarded the Nobel Peace Prize in 1904 , is the further development of international law. In the same year he was nominated for the award because of his services to international law and international arbitration .

From 1868 he was married to the poet Grazia Pierantoni-Mancini , a daughter of the lawyer Pasquale Stanislao Mancini , who was also involved in founding the Institut de Droit international and became its first president.

Legal philosophical views

Augusto Pierantoni saw the foundations of international law primarily in a number of general principles, including the principle of nationality and the principle of non-interference, and viewed their dissemination as a prerequisite for the progress of international law. This view of the development of international law through an interaction between ideas and their practical design was opposed by the legal positivist view that was also widespread in international law at the time , which saw the basis of law solely in written norms.
