Under barratry (of ital. Baratteria = fraud ) is understood in the maritime wrongful act of the captain or the crew of a ship; the Duden defines it as "dishonesty of the ship's crew towards shipowners or freight owners (in maritime law )".

The term goes to the Italian term Baratteria within the meaning of bribery back or fraud. It describes an intentional act by the captain or crew of a ship that causes damage to the ship or the cargo to the detriment of the freight forwarder or the shipping company . An act with the consent of the shipping company to the detriment of the freight forwarder does not fall under the term baratterie.

Examples of barattery can be: smuggling , drilling into or incapacitating ships, breaking sea ​​blockades , resisting a warship that makes use of search rights or violating navigation laws .
