In the Bavarian division of 1376 , the Duchy of Bavaria was divided among his heirs after the death of Duke Stephen II (with the custody) . It was a purely administrative dichotomy while maintaining the overall political government for the entire duchy, but without Straubing-Holland . The Duchy of Upper Bavaria should initially be under the administration of Duke Stephan III. and Duke Johann II. , Bayern Landshut under the administration of Duke Frederick and Duke Otto V stand. So that neither party would be disadvantaged, the government areas should change every two years. However, this unusual regulation was not implemented.

In contrast, Duke Johann tried in 1384 and 1387 to achieve a real division of the country. However, he failed due to the resistance of his brothers and the Upper Bavarian estates and had had to promise in 1384 in Aichach and 1390 in Munich to continue the joint governance. It was not until 1392, with the help of his son Ernst, that he was able to win the city of Munich and part of the estates on his side, which probably feared a war between the brothers, that he finally had success. The regulations of the Bavarian division of 1376 were repealed with the Bavarian division of 1392 .
