The Bavarian Archives Act (BayArchivG) has been regulating the archiving of documents in the state archives and in the archives of other public bodies in Bavaria since January 1st, 1990 . At that time Walter Jaroschka was head of the Bavarian State Archives . He played a major role in the creation and elaboration of the BayArchivG.

The law defines the terms archival material and worthy of archiving , lays down the tasks of the state archives in Bavaria, regulates the use of voluntary archivists, obliges the Bavarian authorities to offer their documents to the state archives and regulates the acceptance of the documents. It contains regulations for order archiving as well as the administration and backup of the archive material. It also defines the property rights of those affected. It also defines the responsibilities for the archives of the Bavarian Parliament, the municipalities and other public bodies.

Article 10 regulates the use of the state archives. It records who is allowed to use a state archive under what conditions, when its use is to be prohibited and how long archive material is blocked ( protection periods ). The protection periods of the Bavarian Archives Act correspond to those of the Federal Archives Act .
