Right of participation

The right of participation is a term from historical inheritance law . It denotes a right of use by the surviving spouse to certain inheritance objects inherited from the deceased spouse to their children, in particular to real estate .

In Freiburg's city law of 1520, the Roman notional inheritance law is combined with German law institutes such as matrimonial property law . In place of the old law Verfangenschaft the immediate division of the goods masses occurs with Beisitzrecht.
