Job name

A professional name means two things:

Surnames

Family names are classified as professional names in onenology if they are derived from a professional title ( Müller , Schmidt , Koehler , Fischer , etc.). Further examples can be found under German surnames .

Artist or job names

In German jurisprudence, the name used in professional life is sometimes understood to mean that it differs from the name that is binding under civil status law. For artists, this professional name is called the artist name . The possibility of using a professional name is not limited to artists in Germany, but on the contrary only prohibited in exceptional cases (as with notaries). According to a ruling by the Federal Constitutional Court of March 8, 1988 , such professional names could also be noted in the column name of the order or artist on the identity card or passport . However, the authorities had a leeway here if it was not certain that the name was already used in the public domain or if it was not certain that the bearer of the name was already known by this name. In the meantime the possibility of entering religious or artist names in passports has been abolished. In response to numerous submissions from those affected, however, the religious or artist name was reintroduced into passport, identity card and registration law with effect from 2010.

When spouses still had to use a common married name, this was recommended as a stopgap solution if a common name is not desired. For example, Mrs. Gabler-Mustermann, born Gabler in professional life continued just Gabler call. Today this can still be of interest in the event of a separation of the spouses, because a married name once adopted can only be discarded after the marriage is dissolved (Ms. Mustermann née Gabler separates from Mr. Mustermann, officially takes the double name Gabler-Mustermann and calls herself in Working life simply Gabler ). The employer may use this name in general, but he cannot be forced to do so, especially since he cannot avoid using the official name for the tax office and the social security funds.

Another example of such a name is given by earlier nobility titles . Here, too, the long, full name often becomes a shorter version in everyday life, in which the from is often postponed. A prominent example is the former chairman of the Siemens AG Supervisory Board Heinrich Pierer von Esch, commonly known as Heinrich von Pierer ; Another example is Karl-Theodor Freiherr von und zu Guttenberg, known for short as Karl-Theodor zu Guttenberg .

Switzerland

In Switzerland , too , an entry in the passport is possible under certain circumstances (see alliance name ). However, if one does not already have one's own right to a name for the chosen professional name (e.g. because it is the maiden name), another bearer of the same name can prohibit its use as long as the professional name has not achieved market recognition, i.e. as long as he does not himself because of it Traffic validity is protected by name.
