District Court (GDR)

from Wikipedia, the free encyclopedia

The district court was a court of ordinary jurisdiction of the second instance in the GDR and for a transitional period also in the new federal states .

General

In 1952 the states in the GDR were abolished and a central state was established. The organization of the courts also followed the administrative structure: District courts were subordinate to the Supreme Court of the GDR . A district court was set up for each district of the GDR . The district courts were in turn subordinate to district courts for each district.

The district courts served as the second instance for appeals against judgments and other decisions of the district courts and as the first instance for criminal matters with high threats of punishment. In the first instance, the Leipzig District Court was exclusively responsible for legal disputes in the areas of patent, design, trademark and copyright law (also primarily vis-à-vis the State Contracting Court ).

The district courts were the successors of the previous regional courts . After the restoration of German unity, the federal judicial system was also established in the new federal states in accordance with the Courts Constitution Act . The district courts were converted back into regional courts.

In 1989 there were 324 judges working in the district courts and 336 prosecutors in the district prosecutors. In the mid-1980s, a district court director received between 2100 and 2500 marks in salary and 300 marks for service expenses.

East Berlin special case

East Berlin was not part of the GDR due to its four-power status . There, based on the GDR court structure, the ordinance of the East Berlin magistrate of November 21, 1952 on the " Constitution of the Courts of Greater Berlin " stipulated that the jurisdiction of the Superior Court of Justice as the Supreme Court of Greater Berlin, the City Court and the city district courts is exercised. The city court was called "City Court of Greater Berlin" until 1977, then "City Court Berlin, Capital of the GDR".
