The District Court for Commercial Matters Vienna is an Austrian district court with its seat in the justice center Wien-Mitte in the Viennese district Landstrasse . The federal government is the court holder . The court was established on October 1, 1873 as a minor court for commercial matters and, according to its name, is exclusively responsible for commercial matters in accordance with Section 52 Jurisdiktionsnorm (JN).

Material jurisdiction

The district court is materially responsible for the items listed below, provided the amount in dispute is not greater than 15,000 euros :

  • Disputes from company-related transactions if the action is directed against an entrepreneur entered in the commercial register and the business on the part of the defendant is a company-related transaction;
  • Disputes that arise from the professional business of commercial brokers (sensals), scales, knives and other persons who are appointed to carry out and confirm such business transactions, if these disputes are conducted between them and their clients;
  • Disputes arising from the legal relationships between the entrepreneurs and their authorized signatories, authorized representatives and agents, as well as from the legal relationships between all these persons and third parties to whom they have made themselves responsible in the employer's company, and from the legal relationships between third parties and those persons who have no power of attorney or Power of attorney are liable unless it is a matter of labor law;
  • Disputes arising from the sale of a company between the parties to the contract;
  • Disputes about the right of use of a company and the disputes arising from that right;
  • Disputes arising from the legal relationship between the members of a trading company or between it and its members, between the members of the administration and the liquidators of the company and the company or its members, between the silent partner and the owner of the company, between the participants of an association to individuals Company-related transactions for joint account as well as disputes arising from legal relationships between all these persons and third parties to whom they have made themselves responsible in this capacity, in all these cases both during the existence and after the dissolution of the social relationship, unless it is a Is a labor matter;
  • other disputes under the Stock Corporation Act and the Law on Limited Liability Companies ;
  • Disputes from bill of exchange transactions and from recourse claims under check law;
  • Disputes under the Product Liability Act;
  • Disputes according to § 1330 ABGB due to a publication in a medium (§ 1 Paragraph 1 Z 1 Media Act).

This responsibility arises from §§ 51 and 52 JN.

Local jurisdiction

The District Court for Commercial Matters Vienna is responsible for the entire Viennese municipality (cf. § 3 District Court Organization Act for Vienna).

Appeal and supervision

The appeal against decisions of the District Court for Commercial Matters Vienna goes through the Commercial Court Vienna to the Supreme Court. The Higher Regional Court of Vienna oversees the administration of justice .
