Constitutional Review Commission

The Constitutional Review Commission (CRC) is a commission that was set up in The Gambia in 2018 to develop proposals to amend the Gambia's 1997 constitution .

Establishment and duties

The Constitutional Review Commission was established in 2018 after the National Assembly passed the Constitutional Review Commission Act on December 13, 2017, which President Adama Barrow signed on January 13, 2018. The resolution envisaged the establishment of a commission consisting of a chairman and a deputy as well as nine other members to be nominated by the president.

The task of the commission is to draft a new constitution or reform the existing one. In particular, the public should be consulted on this. The dissolution of the commission is to take place one month after the entry into force of an amended constitution.

On June 4, 2018, the eleven members of the commission were sworn in.

Consultations with Gambian citizens abroad began on April 30, 2019 with an event in Dakar (Senegal). Other events abroad took place in Nouakchott (Mauritania) and Jeddah (Saudi Arabia) , among others . In June and July 2019, the CRC held events in the USA and Europe.

In September 2019, the commission announced that the Kenyan judge Willy Mutunga and the Ghanaian lawyer Albert K. Fiadjoe would advise the CRC on drafting a constitution.

On November 15, 2019, a draft constitution was presented to the public. As a result, there were public debates on individual aspects, for example the role of religion or homosexuality. Submissions and comments on the draft could be submitted to the CRC by the end of December 2019.

In February 2020, representatives from the Bingham Center for the Rule of Law , an independent research institute in the UK, visited Banjul. The research institute, founded by the British Institute of International and Comparative Law , is dedicated to the study and promotion of the rule of law worldwide. They were included in the deliberations on the Gambia's new constitution. The Bingham Center for the Rule of Law praised the drafting of the constitution and the process so far.
