Dieter Wolst

Dieter Wolst (born March 20, 1944 in Nuremberg ) is a German lawyer . From 1995 until his retirement in 2009 he was a judge at the Federal Court of Justice . From 2011 to 2013 Wolst was the ombudsman of the Energy Arbitration Board .

Life

After legal training and a three-year stint in the private sector, Wolst entered the higher judicial service of the Free State of Bavaria in 1974 . There he was used as a probationary judge at the Nuremberg-Fürth regional court and worked for the public prosecutor's office at this regional court. This was followed in 1977 by the appointment of public prosecutor as a lifelong civil servant at this public prosecutor's office. Two years later Wolst was appointed judge at the Erlangen District Court , from where he was seconded to the Nuremberg-Fürth District Court from 1981 to 1987. There he headed a full-time working group for trainee lawyers and has also been an examiner for the first state examination in law since 1985 . In 1988 Wolst was appointed senior public prosecutor at the public prosecutor's office at the Nuremberg Higher Regional Court, from where he had been seconded to the Dresden Public Prosecutor's Office and the Saxon State Ministry of Justice for two years since 1991 . In 1993 Wolst was finally transferred to the Nuremberg Higher Regional Court as a judge.

In 1995 Wolst was appointed judge at the Federal Court of Justice. There Wolst was first the VI. Civil Senate , but then assigned to the VIII Civil Senate until his retirement . Here he was involved in countless Senate decisions, including as a reporter. In addition to the mainly negotiated general sales and rental property, these decisions also dealt with disputes relating to corporate, practice and share purchase law. Lately, Wolst has shifted his activity in particular to residential rental law; an area whose judicial development has always been closely followed by the public. As rapporteur, Wolst was responsible for Senate judgments VIII ZR 361/03 of June 23, 2004 ( “rigid deadline plan” for renovation clauses ), VIII ZR 362/04 of February 22, 2006 ( heat contracting ), VIII ZR 115/03 of January 21, 2004 (rent increases for social housing) and VIII ZR 56/04 of January 25, 2006 ( rent increases ). Wolst also acted as a rapporteur on procedural and cost law.

In addition, Wolst was also employed for many years as an investigative judge at the Federal Court of Justice, from 1996 to 2000 with responsibility in particular for proceedings against left-wing extremist terrorist groups. Wolst was briefly in 1999 and then from 2006 also responsible for proceedings against Islamist associations. After all, Wolst was a deputy and full member of the judges' council of the Federal Court of Justice for a long time .

From 1 November 2011 to 31 October 2013 was Wolst Ombudsman pursuant to § 111a / b EnWG make arbitration body energy e. V. and was responsible for the arbitration .
