Declaration of Incorporation

A declaration of incorporation within the meaning of the new version of the Machinery Directive 2006/42 / EC of the European Parliament and the Council of May 17, 2006 is issued for an incomplete machine by the manufacturer or his authorized representative .

According to Annex II B of the directive, it must contain the information that the commissioning of a machine or system in which this component is built is prohibited until conformity with the directive has been established. In addition, the declaration (in addition to the previous regulation) must contain the following information:

  • Company name and address of the manufacturer of the partly completed machine and, if applicable, his authorized representative;
  • Name and address of the person responsible for the documentation ; he must be based in the EC ;
  • In addition to the description, information on identification ( designation , function , model, type, serial number , trade name );
  • a declaration of which requirements of the Machinery Directive are applied and a declaration that the technical documents have been drawn up in accordance with Annex VII B;
  • a declaration of commitment to submit documents to government agencies upon justified request; the form of transmission must also be specified;
  • a notice that the commissioning of the partly completed machine is prohibited until the conformity of the machine or system into which the partly completed machine is to be installed with the directive has been established.
  • Place, date and information on the person who signs the declaration of incorporation on behalf of the manufacturer or his authorized representative.

According to the Machinery Directive, a CE marking is not permitted for incomplete machines. Since December 29, 2009, the declaration of incorporation has replaced the previous manufacturer's declaration of the Machinery Directive 98/37 / EC of June 26, 1998 in a legally binding manner .
